LAS CRUCES – The Las Cruces Public Schools Board of Education could take action Tuesday on a lease default and proposed sublease involving the district-owned property at 402 W. Court Ave., home to Alma d’Arte Charter High School.
The Oct. 20 meeting agenda lists possible action concerning the property’s existing lease, including the lessee’s default and a subsequent request for permission to sublease.
However, the public packet does not identify the nature of the default, name the proposed subtenant, disclose any financial terms or include a proposed motion explaining what the board might approve.
Alma d’Arte, a charter high school that has operated in the former Court Youth Center building since 2004, lists 402 W. Court Ave. as its address. The agenda does not expressly identify the school as the lessee in default.
The property has already been discussed behind closed doors. Minutes from the board’s Sept. 29 work session confirm members met in executive session to discuss lease and sublease matters involving the same address, citing the real-property exception under New Mexico’s Open Meetings Act.

Tuesday’s agenda again lists possible action, but the absence of supporting lease documents leaves the public without information needed to evaluate the proposed transaction.
The board’s regular meeting begins at 6 p.m. Tuesday, Oct. 20, at the Dr. Karen M. Trujillo Administration Complex, 505 S. Main St., Suite 249.
